When you are injured as a result of another person's negligence in any automobile accident you may have certain legal rights. You may be entitled to compensation for medical bills, pain and suffering, lost wages, loss of future wages, loss of enjoyment of life and, in some instances, punitive damages. Contrary to what they might hope that you would believe, adjusters do not work for you. To recover from another party in a personal injury action, the other party must commit a negligent act. Not only must negligence be proven, but it is also important that you are not negligent. In North Carolina, if you, through any negligence of your own, contribute to your own injury, then you are completely barred from recovering damages of any kind from the negligent party.
Damages must also be present in order to recover from one's negligence. Damages, entitling the person to medical bills, lost wages, and pain and suffering are called compensatory damages. You may also be able to recover punitive damages, which are damages awarded to the injured person to punish the negligent party for his wrongful conduct. For example, a situation which may involve punitive damages occurs when the negligent person commits the wrongful act while under the influence of alcohol at the time of the act.
